How Drug Charges Move Through Bexar County Courts

Bexar County has ten Criminal District Courts with original jurisdiction over felony criminal matters. Several factors, such as the court assignment, the charge level, bond conditions, and procedural history, can affect how the proceedings move through the local system.

Bexar County also maintains specialty drug court and diversion pathways for some defendants, but participation isn’t automatic or guaranteed. Eligibility depends on the specific charges, one's criminal history, and individual program requirements.

Eligibility for diversion, deferred adjudication, or probation depends on the charge, criminal history, and applicable program rules. Record-clearing options require a separate analysis under Texas law.

Why Local Courtroom Experience Matters in Drug Possession Cases

Drug possession cases are not handled the same way in every courtroom. Prosecutors differ in which cases they will reduce, dismiss, or send to a diversion program, and judges differ in how they rule on motions to suppress evidence, set bond conditions, and structure probation. An attorney who has worked these cases locally knows what to expect from each, and that shapes how a negotiation or hearing is approached.

Local experience also helps with the evidence. Many possession cases turn on how the police stop, search, and collect evidence, and a lawyer who knows how local agencies operate can spot the weak points faster, such as an unlawful stop, a questionable search, or a gap in the handling of evidence. When the case is about who possessed the drugs, not whether drugs were found, knowing how local prosecutors build that argument matters just as much.

The LaHood family's legal practice has represented the criminally accused since 1967. Led by trial lawyer Marc LaHood, our team prepares every defense as though it could go to trial, which gives clients real leverage in plea discussions and an honest assessment of their options. We cannot promise a particular result, but we can bring decades of local courtroom knowledge to your case.

What to Do After an Arrest for Drug Possession in San Antonio

What you say and do during and after an arrest matters. You may (and should) invoke your right to remain silent, as well as ask for an attorney before answering substantive questions about the alleged substance, where it was found, or who it belonged to.

Here's what to do (and what not to do) during an after an arrest:

  • Stay calm and do not resist. Even if you believe the arrest is unlawful, do not run, argue, or physically resist. Resisting can add new charges and hurt your credibility later. Challenging the arrest is your attorney's job, in court.
  • Say clearly that you want a lawyer and will remain silent. Do not try to explain, deny, or talk your way out of it. Statements about whose drugs they were, where they came from, or how much you used can be used against you, even if you are innocent.
  • Do not consent to any search. If officers ask to search your car, home, bag, or phone, say plainly, "I do not consent to a search." Saying this does not stop them from searching, but it preserves your attorney's ability to challenge it later.
  • Do not discuss your case with anyone but your attorney. Phone calls from jail are recorded, and other people in custody may repeat what you say. This includes friends and family, so keep the details to yourself.
  • Stay off social media. Do not post, comment, or delete anything about your arrest or the charge. Prosecutors can use posts as evidence, and deleting content can look like you are hiding something.
  • Write down what happened as soon as you can. Note why you were stopped, what officers said and did, whether they had a warrant, what they searched, and who was present. Details fade quickly, and they can reveal problems with the stop or search.
  • Keep every document you are given. This includes citations, booking paperwork, bond papers, and release conditions. Take photos of them so nothing is lost.
  • Follow your bond conditions exactly. If you are released, comply with every requirement, such as check-ins, drug testing, travel limits, or no-contact orders. A violation can send you back to jail and weaken your position in negotiations.
  • Never miss a court date. Write down every hearing date and deadline you are given. A missed appearance can lead to a warrant for your arrest and additional charges.
  • Contact a criminal defense attorney right away. The sooner a lawyer is involved, the sooner evidence can be preserved and the stop and search can be examined.

As your legal team, we stay accessible and responsive throughout your defense, explaining complex and sometimes confusing information plainly so you can make informed decisions about how to proceed.
